Terms of Service

By ticking the box at sign-up, clicking to accept, or using Caelpost, you agree to these Terms and the Privacy Policy. If you use Caelposton behalf of a company or client, you confirm you are authorised to bind them, and “you” includes that organisation. If you do not agree, do not use Caelpost.

• You must be at least 18 years old and able to form a binding contract.
• Give accurate information and keep it up to date.
• Keep your login credentials secure. You are responsible for everything done through your account and your workspace members.
• Tell us immediately at security@caelpost.com if you suspect unauthorised access.

Caelpost lets you create, schedule and publish content to social networks, analyse performance, generate content with AI, and run automations such as Comment-to-DM on Instagram. We may add, change or remove features over time. We will give reasonable notice before removing a paid feature you rely on.

• You may only connect accounts you own or are authorised to manage.
• When you connect an account you authorise Caelpost to access it and act on it only as you instruct: publishing the content you schedule, reading comments and messages needed for your automations, sending the replies you configure, and reading insights.
• You must follow the rules of each network you connect, including Instagram’s Terms of Use, Community Guidelines and Meta’s Platform Terms. Content you publish through us is your responsibility.
• Networks can change or limit their APIs at any time. We are not responsible for posts a network rejects, delays or removes, or for actions a network takes against your account.
• You can disconnect an account at any time in Caelpost or from the network itself. Disconnecting stops publishing and automations for that account.

If you use Comment-to-DM or other messaging automations, you agree that:

• Automated messages are sent only to people who first commented on your content or messaged your account, and only within the time windows Instagram allows.
• You will not use automations to send spam, unsolicited promotions, misleading links, or content that violates Instagram’s policies or the law.
• The messages, replies and links you configure are your own content and you are responsible for them, including any consumer, marketing or privacy law obligations to the people you message.
• You are the controller of personal data about people who interact with your account. You must have a lawful basis to process it and must honour their requests, and we will help you do so.
• We may pause an automation that causes errors, complaints or rate-limit problems, or that we reasonably believe breaks these Terms.

You must not use Caelpost to:

• Break any law or infringe anyone’s intellectual property, privacy or publicity rights.
• Publish or send content that is illegal, hateful, harassing, sexually explicit involving minors, violent, deceptive or fraudulent.
• Send spam, run engagement manipulation (fake likes, follows or comments), or impersonate others.
• Collect or scrape data about people beyond what the features provide, or sell or share Platform Data.
• Reverse engineer, overload, probe or bypass the security or limits of the service.
• Resell or give others access to the service except as your plan allows.

You keep ownership of everything you upload or create (“Your Content”). You give us a limited, worldwide, non-exclusive licence to host, process, transform (for example resizing, transcoding or clipping) and transmit Your Content only to provide the service to you, including publishing it to the networks you choose. This licence ends when you delete the content or your account, except for copies already published at your request.

You confirm you have the rights needed for Your Content, including any music, footage, images or likenesses in it.

• AI output can be inaccurate or resemble existing material. Review it before you publish; you are responsible for what you publish.
• As between you and us, you own the output generated for you, subject to the terms of the underlying AI providers.
• Do not use AI features to create deceptive content about real people or content that breaks section 6.
• We do not use your content to train AI models.

• Paid plans are billed in advance, monthly or yearly, through Paddle, our merchant of record. Paddle’s buyer terms also apply to your purchase.
• Plans renew automatically until cancelled. You can cancel at any time from Billing; you keep access until the end of the paid period.
• Prices may change with at least 30 days’ notice before your next renewal.
• If you are unhappy within 14 days of your first payment for a plan, email support@caelpost.com for a full refund. Usage-based credits that have been consumed are not refundable.
• Nothing in these Terms limits any refund rights you have under consumer law where you live.

You can stop using Caelpostand delete your workspace at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law or by a network's policies, or if your use harms other users or the service. Where reasonable we will give notice and a chance to fix the problem first. After termination we delete your data as described in the Privacy Policy.

Caelpost relies on third-party services such as Instagram, other social networks, payment and AI providers. Your use of those services is governed by their terms. Caelpost is not affiliated with, endorsed or sponsored by Meta, Instagram or any other network. Instagram is a trademark of Meta Platforms, Inc.

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted service, that every scheduled post or message will be delivered, or any particular reach, engagement or revenue.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you have not paid us. Nothing here limits liability that cannot be limited by law, such as for fraud or death or personal injury caused by negligence.

You will defend and compensate us for claims by third parties arising from Your Content, your automations and messages, or your breach of these Terms or the law.

These Terms are governed by the laws of Kenya. Before starting formal proceedings, please contact us so we can try to resolve the issue informally within 30 days. Disputes will be handled by the courts of Nairobi, Kenya, unless the consumer law of your country gives you the right to bring a claim where you live.

We may update these Terms. For material changes we will notify you by email or in the dashboard and ask you to accept the new version before you continue using Caelpost. The effective date at the top shows the current version.
